1. Acceptance of Terms
By accessing and using the services provided by Arcadia Cabinet Company ("we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services
We provide custom cabinet manufacturing and installation services including but not limited to kitchen cabinets, bathroom vanities, built-in storage solutions, and related cabinetry services. All services are subject to availability and our professional discretion.
3. Client Responsibilities
Clients agree to:
- Provide accurate measurements and specifications for cabinet projects
- Ensure access to installation sites during agreed timeframes
- Review and approve designs and materials within agreed timeframes
- Make payments according to agreed terms
- Prepare installation areas as specified in project agreements
- Respect our team members and property
4. Payment Terms
Payment terms will be outlined in individual project agreements. Generally, a deposit is required to begin work, with progress payments due at specified milestones. Final payment is due upon project completion. Late payments may incur additional fees. We reserve the right to suspend work for overdue accounts.
5. Warranties and Returns
We warrant our workmanship for one year from installation completion. This warranty covers defects in our craftsmanship but does not cover normal wear and tear, damage from misuse, or issues arising from changes made by others after installation. Custom cabinets are made to order and generally cannot be returned unless there is a manufacturing defect.
6. Intellectual Property
Custom designs created for your project become your property upon full payment. We retain ownership of our general methods, techniques, and any pre-existing designs. Clients grant us the right to photograph completed projects for marketing purposes unless otherwise agreed in writing.
7. Project Changes and Delays
Changes to approved designs may result in additional costs and timeline adjustments. We will provide written estimates for any changes before proceeding. Delays due to factors beyond our control (material shortages, weather, site conditions, etc.) may extend project timelines without penalty.
8. Limitation of Liability
Our liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We shall not be liable for any indirect, incidental, or consequential damages including but not limited to lost profits or temporary housing costs.
9. Termination
Either party may terminate a project agreement with written notice. Upon termination, the client remains responsible for payment of all work completed and materials ordered up to the termination date. We will provide any completed work and materials paid for up to that point.
10. Force Majeure
We shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disputes, material shortages, or government actions.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Canyon County, Idaho.
12. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.
